These Terms of Service ("Terms") govern your access to and use of the websites, podcasts, articles, newsletters, online store, and any related products or services (collectively, the "Services") operated by Science of Fishing ("SoF", "we", "us", or "our") at thescienceoffishing.com. By accessing or using the Services you agree to be bound by these Terms. If you do not agree, do not use the Services.
1. Who we are
Science of Fishing is a media and commerce brand built for anglers, covering the science behind fishing through a podcast, written articles, and a curated shop. Some Services are free to access; others (such as products purchased through the shop or paid experiences) are governed by additional terms presented at the time of purchase.
2. Eligibility
You must be at least 13 years old to use the Services. By using the Services you represent that you meet this requirement and have the legal capacity to enter into these Terms. If you are using the Services on behalf of an organization, you represent that you have authority to bind that organization.
3. Accounts
Some features may require an account. You are responsible for safeguarding your credentials and for all activity that occurs under your account. Notify us immediately at the email below if you suspect unauthorized use.
4. Acceptable use
You agree not to:
- Use the Services in any way that violates applicable law or regulation.
- Attempt to gain unauthorized access to, interfere with, or disrupt the Services or any related systems.
- Scrape, mirror, or otherwise copy substantial portions of the Services without our prior written permission.
- Use the Services to harass, abuse, defame, or harm any person.
- Upload or transmit malicious code, or otherwise compromise the integrity of the Services.
5. Content and intellectual property
All content made available through the Services — including podcast episodes, articles, photography, logos, designs, source code, and the SoF name and marks — is owned by SoF or licensed to us, and is protected by intellectual property laws. We grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Services for personal, non-commercial use. You may not republish, redistribute, or create derivative works from our content without our prior written permission.
6. User-submitted content
If you submit comments, reviews, photos, or other content through the Services ("User Content"), you grant SoF a worldwide, royalty-free, perpetual, irrevocable, sublicensable license to use, reproduce, modify, adapt, publish, and display your User Content in connection with the Services and our marketing. You represent that you own or have the necessary rights to grant this license and that your User Content does not infringe any third-party rights.
7. Purchases, shipping, and returns
Products sold through the SoF shop are subject to product descriptions, pricing, and availability shown at checkout. By placing an order you agree to provide accurate, current payment information and to pay all charges. Shipping, returns, and refunds are governed by our shipping and refund policies, where applicable. Where those policies are not yet published, contact us at the email below and we will work in good faith to resolve any issues.
8. Third-party services and links
The Services may include links to or embeds from third-party services (for example, Shopify checkout, audio hosting, video platforms, or sponsor sites). We are not responsible for the content, policies, or practices of those third parties. Your use of any third-party service is at your own risk and subject to that third party's terms.
9. Disclaimers
The Services are provided on an "AS IS" and "AS AVAILABLE" basis, without warranties of any kind, whether express or implied, including without limitation warranties of merchantability, fitness for a particular purpose, non-infringement, or that the Services will be uninterrupted, timely, secure, or error-free. Any information shared through the Services — including fishing techniques, conservation practices, or product recommendations — is for general informational purposes only and is not professional, medical, legal, or safety advice.
10. Limitation of liability
To the maximum extent permitted by law, SoF and its officers, directors, employees, contractors, and partners shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenues, data, goodwill, or other intangible losses, arising from or related to your use of the Services. Our aggregate liability for any claim arising out of or related to these Terms or the Services shall not exceed one hundred U.S. dollars ($100), or, where you have made a purchase, the amount you paid us in the twelve (12) months preceding the claim.
11. Indemnification
You agree to defend, indemnify, and hold harmless SoF and its affiliates from and against any claims, damages, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of or related to your use of the Services, your User Content, or your violation of these Terms.
12. Termination
We may suspend or terminate your access to the Services at any time, with or without notice, for any reason, including if we believe you have violated these Terms. Sections that by their nature should survive termination — including content ownership, disclaimers, limitation of liability, indemnification, and governing law — will survive.
13. Changes to these Terms
We may update these Terms from time to time. When we do, we will revise the "Last updated" date at the top of this page and, for material changes, may provide additional notice. Your continued use of the Services after a change takes effect constitutes acceptance of the revised Terms.
14. Governing law
These Terms are governed by the laws of the State of Florida, United States, without regard to its conflict of laws provisions. You agree that any dispute arising out of or related to these Terms or the Services will be resolved exclusively in the state or federal courts located in Florida, and you consent to personal jurisdiction in those courts.
